* This kitten/s was purchased as a pet, not for breeding. ______
* The Seller recommends that the Buyer have the kitten(s) examined by a licensed veterinarian within the first 72 hours of receipt to ensure their health. ____ 

* The buyer confirms that the Buyer can provide financial care and maintenance for the kitten/s in any condition, including in unforeseen emergencies. _____

* Seller warrants that the kitten/s will be in good health at the time of purchase for 72 hours. The buyer must have the kitten/s examined by a veterinarian within 72 hours. During these 72 hours, if a severe medical abnormality is discovered, the seller will take the kitten back and refund the purchase price less the deposit and any shipping costs, provided that the seller has proper documentation from a licensed veterinarian stating the medical condition and that the cat has a severe medical abnormality; a second examination by a veterinarian of seller's choice confirms these statements. After 72 hours, the seller can no longer guarantee the health of the kittens (except for birth defects)

* The seller guarantees that the kittens are free from congenital diseases for one year from the date of purchase. If a kitten dies within this one-year period due to an apparent congenital disease, it will be replaced, provided that the cause of death is confirmed by a necropsy conducted by a licensed veterinarian, which must include a microchip identification. This necropsy must be performed by a different veterinary clinic and veterinarian.

* We do not provide a health guarantee for viral diseases such as herpes (rhinotracheitis), coronavirus, feline infectious peritonitis (FIP), feline leukemia virus (FeLV), and feline immunodeficiency virus (FIV). It is not possible to provide a health guarantee for these viral diseases, and they are not under the control of the breeder. 

* We provide a one-year warranty against hypertrophic cardiomyopathy (HCM) and polycystic kidney disease. The warranty ends when the kitten/s reaches 15 months of age. To validate the one-year warranty, the customer must provide all documentation from a veterinary cardiologist or nephrologist. The seller reserves the right to either refund the purchase price of the kitten (excluding the customer's veterinary costs) or provide a replacement kitten.

* Replacement will be made with a kitten of comparable quality and value available at the discretion of the Breeder/Seller. Breeder/Seller reserves the right to replace with cash refunding the purchase price. The owner pays for shipping.

* Pet Health Insurance: This agreement requires you to sign up for health insurance for your kitten/s as soon as you bring them home. Using Trupanion health insurance is optional, but as a Trupanion partner breeder, all of our kittens are pre-approved for immediate coverage if our offer is activated within 24 hours of receiving your kitten.

* The seller is not responsible for any veterinary care for this cat after the buyer takes possession of the kitten/s. Under no circumstances will the seller be responsible for any veterinary bills incurred by the buyer. _____

*This kitten/s is sold without breeding rights and under a sterilization/neuter agreement.  Sterilization Deadline  _____

* Buyer agrees that the kitten/s will be neutered/spayed by the time it reaches 7 months at the buyer's expense. When the kitten reaches 9 months, the buyer will provide the seller with documentation that the cat has been neutered.  The Breeder/Seller will supply your kitten's necessary TICA registration documents.

* Buyer agrees not to allow the kitten/s to be declawed under any circumstances.

* Under no circumstances should this kitten/s be allowed to live outdoors or be released outdoors without strict supervision and on a leash.

* Under no circumstances should this kitten/s be tattooed, pierced, or subjected to any unnecessary "fashion" body modification.

* Buyer agrees that under no circumstances will the kitten/s be sold or given to a pet store, animal shelter, research laboratory, or similar facility.

* Buyer agrees that any breach of the terms of this agreement may result in the forfeiture of the kitten/s in question, any registration/pedigree documents, no refund of the purchase price, deposit, or expenses incurred, and Buyer may be subject to monetary compensation to Seller.

* If the kitten is not picked up on the agreed date, the cattery has the right to refuse to sell the kitten to you and put it back up for sale without a refund of the deposit or charge you a fee of $35 per day until the kitten is picked up.

* The buyer is responsible for all transportation costs. The breeder will provide an airline-approved carrier at no additional charge.

* The seller makes no warranties about anything under the airline's control. Suppose any damage is caused by the airline, its officers or employees, or any other party due to the airline's negligence during transportation. In that case, the buyer may sue the party responsible for the damage. The buyer agrees that the kitten will be picked up from the airport on the flight arrival date and time, which both the buyer and the seller will arrange and agree upon.

* Buyer agrees that any legal action will be filed/conducted in Roseburg, Oregon, and assumes responsibility for legal costs.

*Non-Disclosure Obligation*: The recipient (including clients, partners, or visitors) agrees *not* to disclose, reproduce, or share any Confidential Information on social media, forums, or other public platforms without prior written consent from *Shining Blue Cats*.

* The deposit is non-refundable.

·        We do not guarantee that our kittens will be protected from communicable diseases once they leave our home. They are much like small human children, and they will catch them if they come into contact. We offer replacement kitties for congenital or genetic life-threatening birth defects, for example, Hypertrophic Cardiomyopathy, a heart defect (aka HCM), during your kitten’s first year of life. We cannot guarantee your kitten's health if you change our feeding recommendations. Please use the foods we recommend. We strive to breed good health into our bloodlines and do our best, but circumstances sometimes are beyond our control.

·        While we cannot guarantee absolute freedom from parasites for your kitten, we have taken necessary measures to ensure its health. Your kitten has already received two flea drops and was dewormed. We have included this information in the vaccination report that we have provided to you report.

·        We require proof from your veterinarian in the form of copies of medical records if a problem arises. We then discuss this with our veterinarian before making any decisions.

You understand and agree that the owners of this website and cattery shall not be held liable for any direct, indirect, incidental, consequential, or exemplary damages, including but not limited to loss of profits, veterinary expenses, emotional distress, or other intangible losses, arising from the use of this website, the purchase, ownership, care, or handling of a kitten, or any misuse of information, products, or services provided.
