PURCHASER AGREES TO THE FOLLOWING TERMS:

• This kitten(s) was purchased as a pet, not for breeding. _______

• The Seller recommends that the Buyer have the kitten(s) examined by a licensed veterinarian within the first 72 hours of receipt to ensure the kitten(s)’ health. _______

• The Buyer confirms that the Buyer is financially able to provide proper care and maintenance for the kitten(s) in any condition, including in unforeseen medical emergencies. _______

HEALTH GUARANTEE — FIRST 72 HOURS

• The Seller warrants that the kitten(s) will be in good health at the time of transfer to the Buyer. The Buyer is required to have the kitten(s) examined by a licensed veterinarian within the first 72 hours after receipt.

• If, within the first 72 hours, a licensed veterinarian discovers a serious illness or medical abnormality that existed at the time the kitten(s) was transferred to the Buyer, the Seller will take the kitten back and refund the purchase price, less the non-refundable deposit and any transportation or shipping costs.

• To qualify for this guarantee, the Buyer must provide the Seller with proper documentation from a licensed veterinarian confirming the diagnosis and establishing the presence of a serious illness or medical abnormality that existed at the time of transfer.

• The diagnosis must be confirmed by a veterinarian selected by the Seller through an independent veterinary examination.

• After the first 72 hours, the Seller no longer provides a general health guarantee for the kitten(s), except for the guarantees covering congenital and genetic conditions specifically stated in this Agreement.

CONGENITAL AND GENETIC HEALTH GUARANTEE

• The Seller warrants that the kitten(s) is free from congenital or genetic conditions that are life-threatening or require ongoing medical treatment and that existed before or at the time of transfer to the Buyer, for one year from the date of purchase.

• If, within one year from the date of purchase, the kitten is diagnosed with such a congenital or genetic condition, the Buyer must provide the Seller with complete medical documentation supporting the diagnosis.

• If the kitten dies within one year from the date of purchase as a result of a congenital or genetic condition, the cause of death must be confirmed by a necropsy performed by a licensed veterinarian. The necropsy must include identification of the kitten by its microchip number.

• The necropsy must be performed by a veterinary clinic and veterinarian not involved in the original diagnosis, whenever reasonably possible.

HCM AND POLYCYSTIC KIDNEY DISEASE

• The Seller provides a separate one-year guarantee against hypertrophic cardiomyopathy (HCM) and polycystic kidney disease (PKD) from the date of purchase.

• This guarantee remains in effect for one year from the date of purchase but in no event extends beyond the date the kitten reaches 15 months of age, whichever occurs first.

• To qualify for this guarantee, the Buyer must provide complete medical documentation from a licensed veterinary cardiologist for HCM or a licensed veterinary specialist in kidney disease/nephrologist for PKD.

• The diagnosis must be confirmed by the appropriate veterinary specialist and supported by written medical documentation.

• In the event of a confirmed diagnosis of HCM or PKD, the Seller reserves the right, at the Seller’s discretion, either to refund the purchase price of the kitten or provide a replacement kitten. The Buyer’s veterinary expenses are not reimbursed.

• Replacement will be made with a kitten of comparable quality and value available at the discretion of the Breeder/Seller. The Breeder/Seller reserves the right to provide a cash refund of the purchase price instead of a replacement kitten.

• The Buyer is responsible for all transportation costs associated with a replacement kitten.

VIRAL AND COMMUNICABLE DISEASES

• We do not provide a health guarantee for viral diseases such as herpes (rhinotracheitis), coronavirus, feline infectious peritonitis (FIP), feline leukemia virus (FeLV), or feline immunodeficiency virus (FIV).

• The Seller does not guarantee that the kitten(s) will remain protected from infectious or communicable diseases after leaving the Seller’s home. After the kitten(s) is transferred to the Buyer, the Seller has no control over the kitten’s environment, contact with other animals, or exposure to infectious diseases.

• These diseases are not covered by the general 72-hour health guarantee unless expressly provided otherwise in this Agreement.

PARASITES

• While the Seller cannot guarantee that the kitten(s) will be completely free of parasites, the Seller has taken reasonable measures to protect the kitten’s health before transfer.

• The kitten has received two flea treatments and has been dewormed. This information is included in the veterinary/vaccination records provided to the Buyer.

FEEDING

• The Seller provides the Buyer with feeding recommendations for the kitten.

• The Buyer understands that changing the recommended diet may cause digestive upset or other health problems related to dietary changes. The Seller is not responsible for illnesses or medical conditions directly caused by the Buyer’s change to the recommended diet or improper feeding.

• The Seller recommends that the Buyer follow the food and feeding guidelines provided by the Breeder.

PET HEALTH INSURANCE

• Pet Health Insurance: This Agreement requires the Buyer to obtain health insurance for the kitten(s) as soon as the kitten(s) is received.

• Use of Trupanion pet health insurance is optional. However, as a Trupanion partner breeder, all of our kittens are pre-approved for immediate coverage if the offer is activated within 24 hours of receiving the kitten.

VETERINARY EXPENSES

• After the kitten leaves the Seller’s care, all veterinary care and related expenses become the sole responsibility of the Buyer.

• The Seller shall not be responsible for any veterinary fees, medical expenses, or treatment costs incurred by the Buyer after the transfer of the kitten, except for a refund of the purchase price or provision of a replacement kitten in cases expressly covered by this Agreement.

• If a medical problem arises, the Buyer must provide the Seller with copies of the kitten’s medical records and any other relevant veterinary documentation. The Seller will review the information with the Seller’s veterinarian before making a decision regarding any matter covered by this guarantee.

SPAY/NEUTER REQUIREMENT

• This kitten(s) is sold without breeding rights and is subject to a spay/neuter agreement.

Spay/Neuter Deadline: November 20, 2026. _______

• The Buyer agrees that the kitten(s) will be spayed/neutered by the time the kitten reaches 7 months of age, at the Buyer’s expense.

• When the kitten reaches 9 months of age, the Buyer must provide the Seller with documentation confirming that the kitten has been spayed/neutered.

• The Breeder/Seller will provide the necessary TICA registration documents after the spay/neuter requirement has been fulfilled.

DECLAWING PROHIBITED

• The Buyer agrees that under no circumstances will the kitten(s) be declawed.

OUTDOOR ACCESS

• Under no circumstances may the kitten(s) be kept outdoors or allowed to roam outdoors without strict supervision and a leash.

BODY MODIFICATIONS

• Under no circumstances may the kitten(s) be tattooed, pierced, or subjected to any unnecessary “fashion” body modifications.

PROHIBITED TRANSFER

• The Buyer agrees that under no circumstances will the kitten(s) be sold or given to a pet store, animal shelter, research laboratory, or similar facility.

BREACH OF AGREEMENT

• The Buyer agrees that any breach of the terms of this Agreement may result in the Seller requiring the Buyer to return the kitten(s) to the Seller, forfeiture of any registration documents or pedigree, no refund of the purchase price, deposit, or expenses incurred, and the Buyer may be responsible for monetary damages to the Seller.

• If the Buyer violates any material term of this Agreement, the Seller reserves the right to demand the return of the kitten(s) to the Seller. The Buyer agrees to promptly return the kitten(s) upon such demand, at the Buyer’s expense. No refund of the purchase price, deposit, or other expenses will be provided unless expressly required under another provision of this Agreement.

FAILURE TO PICK UP THE KITTEN

• If the kitten is not picked up on the agreed-upon date, the cattery has the right to refuse to complete the sale and place the kitten back up for sale without refunding the deposit, or charge a boarding fee of $35 per day until the kitten is picked up.

TRANSPORTATION

• The Buyer is responsible for all transportation costs.

• The Breeder will provide an airline-approved carrier at no additional charge.

• The Seller makes no warranties regarding any circumstances that are under the control of the airline.

• If any damage is caused by the airline, its officers or employees, or any other party as a result of the airline’s negligence during transportation, the Buyer may pursue a claim against the party responsible for the damage.

• The Buyer agrees to pick up the kitten from the airport on the flight arrival date and at the arrival time agreed upon by the Buyer and Seller.

VENUE FOR LEGAL ACTION

• The Buyer agrees that any legal action arising from or relating to this Agreement will be filed and/or conducted in Roseburg, Oregon, and the Buyer assumes responsibility for legal costs.

NON-DISCLOSURE OBLIGATION

• Non-Disclosure Obligation: The recipient, including clients, partners, or visitors, agrees not to disclose, reproduce, copy, publish, distribute, or share any Confidential Information belonging to or relating to Shining Blue Cats on social media, forums, websites, or any other public or private platform without the prior written consent of Shining Blue Cats.

• For purposes of this Agreement, Confidential Information includes, but is not limited to, private information concerning the cattery, breeding program, breeding lines, pedigrees, planned or future breedings, business operations, clients, suppliers, veterinary information, photographs or videos not publicly released by Shining Blue Cats, and any other non-public information provided to or obtained by the recipient in connection with Shining Blue Cats.

• The Buyer agrees not to use or disclose such Confidential Information for any purpose other than the care and ownership of the kitten(s), unless prior written consent is obtained from Shining Blue Cats.

DEPOSIT

• The deposit is non-refundable.
